SAZbike: What do dealers have to consider when offering bikes under their own brand-name?
Dirk Zedler: Basically, the one who puts his name or his brand on a product, is the manufacturer in the eyes of the law. You assume the role of a bike manufacturer at full volume. And with this, all rights and duties arising from the product liability law and similar laws.
SAZbike: What else does the manufacturer have to consider when assembling bikes himself?
Dirk Zedler: It is important to attach an owner's manual in the respective country's mother tongue to his self-assembled bikes. There are verdicts by the Federal Supreme Court, the counry's highest court, in which a manufacturer of drinks dispensers was sentenced to paying damages after an operating error because only an English owner's manual was included. Such things gain more and more importance in jurisdiction. Further, owner's manuals are not only important when it comes to liability, but are also a sign of good customer service.
